Are employers required to provide employee health benefits?
Employers in Hawaii are generally not required to provide health benefits to their employees. However, the Hawaii Prepaid Health Care Act of 1974 requires certain employers to provide a health plan for their employees. This law applies to employers with 100 or more employees, and it requires employers to cover at least a minimum of 50% of the employee’s health care costs. The law also sets a cap on how much employers can require their employees to pay for health care premiums. The Affordable Care Act (ACA) also requires employers with more than 50 full-time employees to offer health insurance coverage or pay a penalty. However, this law does not apply to employers in Hawaii, as Hawaii already has a system of employer-based health care. Additionally, Hawaii’s small business health insurance program allows small businesses with fewer than 25 employees and who meet certain requirements to purchase health plans through the state’s Small Business Health Options Program. Overall, employers in Hawaii are not generally required to provide health benefits to their employees.
