What are the requirements for providing workers' compensation?

In Virginia, employers who have at least three employees are required to provide workers’ compensation for their employees. Workers’ compensation is a type of insurance that provides medical benefits, wage replacement, and death benefits to employees if they get hurt or become ill while on the job. Employers must provide workers’ compensation insurance through a private insurance company or through a state-run insurance fund. The employer is responsible for the cost of the insurance and must pay all premiums in full. Employers must give notice to employees that they are covered by workers’ compensation insurance. This notice must be in writing, posted in the workplace, and given to each employee at the time of hire. All employers must also keep accurate records of all injuries and illnesses that occur on the job, and they must report any serious injuries or deaths that occur to the Virginia Workers’ Compensation Commission. Finally, employers must display a poster in the workplace that explains workers’ compensation and informs employees of their rights and obligations under the law. This poster must be in a visible place and must be in both English and Spanish.
