What is the difference between constructive dismissal and wrongful dismissal?

Constructive dismissal and wrongful dismissal are both legal terms used to describe employee terminations in Virginia. The main difference between the two is that wrongful dismissal simply means that an employee was terminated unlawfully, while constructive dismissal refers to an employee who was forced to quit due to their employer’s intolerable working conditions. The most common form of wrongful dismissal in Virginia is when an employer terminates an employee without following the correct protocol and without providing adequate notice. This usually occurs when an employee is let go without being given the chance to improve their performance or due to economic reasons. On the other hand, constructive dismissal occurs when an employer places intolerable working conditions on the employee to the point where it is not reasonable to continue in the role. Examples of this could include changing an employee’s job description to one that is beneath them, reducing an employee’s salary or benefits, or even making the work environment so hostile that it is impossible to stay in the job. To prove constructive dismissal, the employee must prove that their working conditions were so bad that it was impossible for them to stay in their role.
