Are employers allowed to require employees to work on holidays?
In the state of Kansas, employers are allowed to require employees to work on holidays if certain conditions are met. Employees must receive a minimum of one and one-half times their regular rate of pay if they work on holidays. Additionally, any work done on the holiday must not exceed twelve hours in any twenty-four hour period. Employers can also require employees to work on Sundays, with the same overtime pay rules applied. Employees who work on holidays must be provided with a minimum of two days off for every holiday that they work. If the employee works on a holiday that falls on their regularly scheduled day off, they will receive four days off. All employers must document the time off given to an employee for each holiday that they work. Employers also need to take into consideration any contracts or collective bargaining agreements that may be in place with their employees. If these agreements require employees to be allowed to take a certain number of days off or receive a specific rate of pay for working on holidays, the employer must adhere to the terms of the agreement. The laws in Kansas regarding working on holidays do not automatically guarantee an employee the right to take the day off. The decision rests with the employer. However, employers should be sure to follow the regulations and rules in place to ensure that their employees are being treated fairly and receive all of their benefits and entitlements.
