What is a juvenile court hearing?

A juvenile court hearing is a legal proceeding in Virginia that is used to adjudicate a variety of cases involving juvenile or youth offenders. The purpose of this hearing is to determine whether the accused committed the alleged offense and to determine what action should be taken in response. Juvenile court proceedings are conducted differently than adult court proceedings, and involve different legal representation, rules of evidence, and sentencing considerations. Juveniles who are accused of committing a crime are entitled to certain rights and protections. For example, Virginia law states that a juvenile has the right to an attorney and that proceedings be conducted in the presence of the juvenile’s parent or legal guardian, who must be informed of all proceedings. Additionally, juvenile court proceedings cannot be open to the public without the written permission of the court. During the hearing, the judge will determine whether the accused committed the offense and if so, will issue a disposition. A disposition can include a dismissal of the charges, a finding of guilt and a referral for probation, or a finding of guilt and an order for the juvenile’s placement in a residential facility. It is important to note that the goal of the juvenile justice system is to rehabilitate a juvenile offender, not to simply punish them. As such, the court may consider the juvenile’s background and any additional factors that may impact their rehabilitation when making their decisions.
