What is a restraining order?

A restraining order is a legal order issued by a court in Virginia that requires the person against whom the order is issued (the “respondent”) to refrain from specific acts or activities. Generally, restraining orders are issued when a family members feel that they are in danger of being abused or wronged. Generally, a restraining order addresses contact that the respondent is not allowed to make with the person or persons who requested the order. When a restraining order is issued in Virginia, the respondent is typically not allowed to communicate with the protected person or persons in any way, including in person, by phone, in writing, or through third parties. In some cases, the respondent may also be prohibited from entering the home of the protected person or persons. Additionally, the court may order other forms of protection, such as requiring the respondent to forfeit any firearms. Violating a restraining order can result in serious consequences, including criminal charges. The court may also order that the respondent remain in custody until the protected person or persons are no longer in danger. Restraining orders should only be sought when a respondent’s behavior presents a real and imminent danger to the safety of the protected person or persons. It is important to remember that if a restraining order is issued by the court, the respondent must be notified of the order and given a chance to contest it.
