What type of employees are eligible for FMLA leave?

The Family Medical Leave Act (FMLA) provides unpaid, job-protected leave for eligible employees in Washington. Eligibility for FMLA leave depends on both the employer’s size and the employee’s length of service. If the employer is a public agency, regardless of size, or a private employer with 50 or more employees, the employee may be eligible. If the employee works for a business with fewer than 50 employees but the total number of employees within a 75-mile radius is 50 or more, the employee may still be eligible. For an employee to be eligible for FMLA leave, they must have worked for the employer for at least 12 months and at least 1,250 hours in the 12 months prior to the start of their leave. The employee must also work at a location where the employer has 50 or more employees within a 75-mile radius. Eligible employees may take up to 12 weeks of unpaid leave in a 12-month period for certain medical and family-related leave needs. This leave may be taken for the employee’s own medical condition or for the care of a family member with a serious health condition. Leave may also be taken for the birth or adoption of a child, or for care of a family member who is a covered service member. In conclusion, for an employee to be eligible for FMLA leave, their employer must meet the size requirement and the employee must meet the duration and hour requirements. If the employer and employee both meet these requirements, the employee may be eligible for up to 12 weeks of unpaid, job-protected leave in a 12-month period.
