How many days of leave am I entitled to under the FMLA?

In Texas, if you are an eligible employee, you are entitled to up to 12 weeks of unpaid leave under the Family and Medical Leave Act (FMLA). Your employer may also require you to use any of your accrued paid leave (such as vacation or sick leave) in conjunction with the FMLA. The 12 weeks of FMLA is calculated as 12 work weeks within a 12-month period. What this means is that you are entitled to 12 weeks of Leave within 12 months of the start of your Leave. For example, if you start your Leave on June 1st, you will be able to take 12 weeks of Leave by May 31st of the following year. In addition to being eligible for up to 12 weeks of FMLA Leave, you will also be able to take additional leave for certain military circumstances. For example, if you have a family member in the military who is on active duty or called to active duty, you may be entitled to up to 26 weeks of military caregiver leave. Therefore, the amount of leave you are entitled to under the FMLA in Texas is up to 12 work weeks within a 12-month period, plus any additional leave that is available for certain military circumstances.
