When can I request FMLA leave?

In Texas, you can request Family and Medical Leave Act (FMLA) leave for a certain reasons, including to take care of yourself or a family member if they have a serious health condition, if you or a family member is in the military, or certain other situations. To be eligible for FMLA leave, you must have worked for your employer for 12 months, and have worked at least 1,250 hours during the 12 months preceding your leave. You can request FMLA leave at any time - there is no set time period for submitting your request. However, you should make sure you provide your employer with enough of a notice to allow them to properly accommodate your absence. If your leave is for medical reasons, then you will need to provide a medical certification form, which is available from the U.S. Department of Labor website. For more information regarding FMLA in Texas, you should contact the U.S. Department of Labor’s Wage and Hour Division or visit their website. If you have any questions or concerns, you should contact a qualified employment law attorney in your area who can advise you on your rights and obligations under the law.
