When can I request FMLA leave?

In Washington, an employee can request Family and Medical Leave Act (FMLA) leave for the following qualifying reasons: 1) to give birth to and care for a newborn child, 2) to care for an ill family member, 3) to provide care for an injured service member, 4) to take time off to manage a serious health condition, or 5) to address certain other qualified matters. In order to take FMLA leave, an employee must have been working for an employer for at least 12 months and have worked at least 1,250 hours over the past 12 months. An employee may file for FMLA for any of these qualifying reasons, provided that the employer is covered by the law and the employee meets the eligibility requirements. An employee typically must provide advance notice when requesting FMLA leave. Employers can require that employees submit a written request no sooner than 30 days before the need for leave, although some employers may allow shorter notice requirements in certain circumstances. Generally speaking, employers must respond to an employee’s request for FMLA within five business days. Employers are required to provide employees with detailed information regarding their FMLA rights, including the right to take leave, the duration of leave, payment and benefits during the leave, and other rights and responsibilities. In Washington, an employee may be able to take up to 12 weeks of unpaid leave during a 12-month period.
