Yes, in Texas, an employee can take FMLA leave in order to care for a family member with an illness that requires frequent medical treatment. According to The U.S. Department of Labor, under the Family and Medical Leave Act (FMLA), eligible employees may take up to 12 weeks of leave in a 12-month period for qualifying family and medical reasons, including to care for a family member with a serious health condition. In order to qualify, the family member must have a serious health condition that requires inpatient care, or continuing treatment by a healthcare provider. This definition includes those situations where the family member needs frequent medical treatments or supervision, such as for diabetes, cancer, or a heart condition. Furthermore, the treatments must involve something more than taking over-the-counter medications or visiting the doctor for routine check-ups. In addition, the employee must meet certain criteria in order to be eligible for FMLA leave. This includes working for an employer with at least 50 employees, working at least 1,250 hours during the twelve months prior to the request for leave, and working on the employer’s premises. If an employee in Texas meets these qualifications, they can take up to 12 weeks of FMLA leave in order to care for a family member with an illness that requires frequent medical treatment.
