How much notice do I have to provide my employer before taking FMLA leave?
The FLMA Law in Washington states that an employee must provide their employer with at least 30 days notice before taking FMLA leave. This applies to employees in both the public and private sectors. In addition to providing the employer with 30 days notice, the employee must also provide medical certification if the leave is for a medical reason. The medical certification must be provided to the employer within 15 days of the employee’s request for a leave of absence. If an employee is medically unable to provide the medical certification within 15 days, they are required to inform the employer within that timeframe that they are unable to provide the certification and inform the employer when they expect to be able to provide it. In the case of an unforeseeable reason for needing to take FMLA leave, the employee must provide notice to their employer as soon as possible. This could mean informing the employer the same day or the day after the employee knows they will need to take the leave. Finally, if an employee is taking FMLA leave due to military exigencies, they are only required to provide their employer with notice as soon as it is reasonable and practicable. It is important to note that if an employee does not provide the necessary notice to their employer of their need for a FMLA leave, the employer can deny their request for FMLA leave.
