Does a grandparent have the right to legal guardianship of a grandchild?
In Washington, a grandparent does not automatically have the right to legal guardianship of a grandchild. However, a grandparent may petition a court for guardianship of a grandchild if certain criteria are met. The court can grant guardianship to a grandparent if it is determined that guardianship is in the grandchild’s best interests. The court generally considers the physical and mental health of the grandchild, the relationship of the grandparent to the grandchild, and the availability of suitable alternatives. In Washington, a grandparent can petition the court for guardianship if the grandchild’s parent is deceased, or if the parent is unable to care for the grandchild due to mental illness, imprisonment, or other factors that make it impossible for the parent to provide for the grandchild’s best interests. The grandparent must prove that the grandchild would be harmed if he or she is not in the grandparent’s care. In Washington, a grandparent may also petition the court for guardianship if the grandchild has been abandoned or is at risk of abuse or neglect. The court typically requires evidence that the parent has not been able or willing to fulfill their parental responsibilities or provide a safe and stable environment. The court must also determine that guardianship is in the best interest of the child. If a grandparent is granted guardianship, they are then responsible for the grandchild’s financial and emotional support. They must provide the child with food, shelter, medical care, and education. Grandparents with legal guardianship of a grandchild must provide the same care as a parent would.
