What is the court process for guardianship?

In Texas, the court process for guardianship is the legal procedure used to appoint a person (or persons) to act as a guardian for another person. Guardianship is usually sought when a person is deemed unable to make his or her own decisions or to take care of their own financial and personal matters. The Guardianship process begins with an application to the court. This application must be filed by someone interested in being appointed as guardian. The court will then review the application, and if approved, the court will order a hearing on the guardianship. At the hearing, the court will consider any objections to the guardianship and may hear from any other interested parties. At the court hearing, a court-appointed investigator will be asked to provide an independent review of the evidence and whether the guardianship is necessary. The court will consider the investigator’s report, along with the other evidence presented at the hearing, in order to determine whether or not to appoint a guardian. If the court approves the guardianship, the court will sign a guardianship order. The order will list what matters the guardian can make decisions on and can also include restrictions and responsibilities for the guardian. The guardian will be required to follow the court order and will be responsible for making decisions in the best interest of the individual in their care.
