How does a guardianship end?

A guardianship in Washington state may end when a guardian is no longer needed. This could be due to the person coming of age, the improvement of their condition, or their death. In Washington, when a guardianship is no longer necessary, the guardian is expected to file a petition to terminate the guardianship with the court. If the ward is 18 or older, the termination must be approved by the court to ensure that the guardian has fulfilled their duties and protected the ward’s interests. The court may require reports and financial accounting from the guardian before ending the guardianship. If the ward is a minor, the court may also require reports and financial accounting before terminating the guardianship. The guardian must also file a notice with the court that the guardianship is no longer necessary. Additionally, the ward’s parent or legal guardian must also sign a consent form that they agree to the termination of the guardianship. A guardianship may also be terminated if the guardian is found unfit to continue in their role. In this case, the court may appoint a different guardian or, if possible, give the ward back their rights. Additionally, if there is a change of circumstance or a change of address for the ward or guardian, the guardian must inform the court to ensure that the guardianship is still valid.
