Who is responsible for a guardian’s legal fees?

In Virginia, the cost of any court-appointed guardianship is usually the responsibility of the person who has been appointed guardian by the court. That is, the individual or organization named in the court order as the guardian is liable to pay the guardian’s legal fees, and any other associated costs. However, it is typically the responsibility of the ward – the person under guardianship – to reimburse their guardian for the cost of their guardianship. This means that if the guardian’s legal fees were paid in cash, the ward must reimburse the guardian for the full amount; if the guardian’s legal fees were paid by credit card, the ward must reimburse the guardian for the full amount owed to the credit card company. In some cases, the court may waive or reduce the guardian’s legal fees. This usually occurs when the court determines that the ward is not able to pay the full amount of the guardian’s legal fees. In this case, the court can order that the ward only be required to pay a portion of the guardian’s legal fees, or even waive the fees altogether. In addition, the court may also award attorney’s fees to the guardian, if the guardian was forced to bring a legal action to protect the ward. In any case, all legal fees incurred in the process of guardianship are the responsibility of the guardian, unless the court decides otherwise.
