What is a durable guardianship?
A durable guardianship is a legal arrangement in Nevada that allows an adult to be appointed by a court to care for an incapacitated person. It is different from a traditional guardianship which only lasts until the incapacitated person passes away or recovers. A durable guardianship is also known as a permanent guardianship because it lasts until the court decides otherwise. This type of guardianship is needed when an adult, such as a parent or family member, is unable to provide for or protect the physical and mental welfare of an incapacitated individual. The court will appoint an individual or organization that can provide the necessary care for the incapacitated person. The court-appointed guardian has certain legal duties and responsibilities. These include making decisions regarding the person’s health, residential arrangements, medical care, and protection from abuse or neglect. The guardian also has the legal right to represent the incapacitated person in court proceedings. The guardian is responsible for abiding by state law and court orders. As such, the guardian must report his or her activities to the court on a regular basis and keep accurate records of all financial transactions. It is important to remember that the durable guardianship is an important legal relationship and must be respected and upheld.
