What happens if a guardian is found to be acting inappropriately?
If a guardian is found to be acting inappropriately in Georgia, the court may decide to revoke the guardian’s appointment. The court may also take other action against the guardian, such as requiring them to take certain courses, pay fines, reimburse any money taken by the guardian, provide suitable housing or care for the person in their guardianship, or limit the powers of the guardian. In addition, the court could order the guardian to pay a certain amount of money to the person or to the state or county in which the guardianship is established. The court can also take away any privileges given to the guardian and take away any economic benefits provided by the guardianship. In extreme cases, the court may also hold the guardian liable for damages resulting from the guardian’s inappropriate actions. This may include legal fees, medical bills, or other expenses incurred from the guardianship. The guardian must take steps to rectify their actions in order to protect the best interests of the person in their guardianship. This could include providing an acceptable plan of care or providing another suitable guardian. If the guardian is unwilling or unable to remedy their actions, the court may remove the guardian from their position. The court may also seek to appoint another guardian to ensure the safety and security of the person in their guardianship.
