What is a Homeowners Association (HOA)?
A Homeowners Association (HOA) is an organization that operates within a subdivision, condominium, or planned community. The purpose of an HOA is to maintain and manage the common areas within the community. Common areas are any parts of the community that are shared by all of the members, such as parks, walkways, and playgrounds. The HOA has many responsibilities, including the enforcement of rules and regulations, collection of assessments or dues, and maintenance of common areas. The HOA is generally managed by a board of directors, usually elected by the residents of the community. The board sets the rules regarding the use and maintenance of common areas, and also has the authority to create bylaws and collect dues, assessments, and fines. In California, HOAs are subject to the Davis-Stirling Common Interest Development Act, which sets forth the rules and regulations governing activities of all HOAs in the state. These rules include the duties and responsibilities of the board, the rights and responsibilities of members, and procedures for meetings, assessments, and enforcement of the rules. HOAs play a large role in the maintenance and management of common areas within communities, and provide a point of contact and an organized body for enforcing the rules. They are also responsible for upholding the Davis-Stirling Common Interest Development Act, ensuring that all communities are in compliance with the state law.
