What are the responsibilities of an HOA?
A Homeowners Association (HOA) is a group of homeowners in a shared community that legally binds every homeowner in the community to comply with certain rules and regulations. In Washington, HOAs are governed by the Washington Common Interest Ownership Act, which sets out the requirements and responsibilities of an HOA. The primary responsibility of an HOA is to maintain and improve the common areas within a community, such as parks, pools, and other recreational facilities. These common areas are owned and managed by the HOA. The HOA is also responsible for managing the community’s finances, including collecting, budgeting, and spending funds appropriately. The HOA is also responsible for enforcing the community’s rules and regulations. This includes making sure that homeowners comply with the HOA’s rules and regulations, such as maintaining their homes, keeping lawns free of trash, and following other requirements set out in the HOA’s governing documents. Additionally, the HOA is responsible for conducting regular meetings and issuing notices to homeowners when an HOA action is taken. The HOA also has the responsibility of representing the interests of the community, such as advocating for changes or improvements that would benefit the community. In Washington, HOAs are also responsible for complying with state laws, such as providing annual financial statements to the Washington State Office of the Attorney General and preparing annual reports for the Washington State Department of Financial Institutions.
