What is the process for resolving disagreements between HOA members?

In Washington State, homeowners associations (HOAs) are subject to a set of laws that govern their operations. To resolve disagreements between HOA members, both parties must first attempt to resolve their differences using non binding methods of alternative dispute resolution, such as mediation or arbitration. If this is not successful, the parties can take the matter to court, where the case will be decided based on state law. In order to begin this process, one party must file a petition for resolution in their local county court. The HOA or attorney can provide the necessary form to do this. The petition should include a description of the dispute, including the argument of the other party, and any evidence or documents related to the dispute. The court will then assign a judge to hear both sides of the case, and decide who is right and who is wrong. The judge can also order the parties to engage in discovery, which involves gathering evidence and documents related to the dispute. The judge will then make a decision based on the evidence presented. If one party is unhappy with the decision, they have the right to appeal to a higher court. It is important to note that while a judge’s decision is binding, it is not always the final say. Parties may still be able to negotiate a settlement between them, with or without the help of a lawyer, if they can come to an agreement. This process is often quicker and less expensive than taking the matter to court.
