What is the International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families?

The International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families is an international human rights law treaty adopted by the United Nations General Assembly in 1990. This Convention was designed to ensure the protection of the rights of all migrant workers and their families, regardless of their status or nationality. It includes a range of civil, cultural, economic, political, and social rights, such as the right to humane working conditions and just remuneration, the right to form and join trade unions and associations, and the freedom of movement and residence. It also provides for the protection of the right to family life, freedom from discrimination, and labor rights. In South Carolina, the Convention was ratified in 2018 and the state has adopted the principles enshrined in the Convention into its domestic law. This includes the implementation of policies that prohibit discrimination based on migrant status, mandate the inclusion of migrant workers in social-protection schemes, and promote migration as a means of development. In addition, South Carolina has a number of laws and initiatives in place to protect the rights of migrant workers, such as the Employment of Migrant Workers in South Carolina Act, which sets out requirements for the reporting of employment information; and the South Carolina Migrant Farmworker Protection Act, which seeks to ensure the humane treatment and access to legal aid for migrant workers.
