How do I dispute an insurance claim decision?
In order to dispute an insurance claim decision in Washington, you must first submit a written statement of the dispute to your insurance company. This should include the policy number, the date of the claim and the reasons why you believe the claim has been unfairly denied. You can also include other documents that show how your rights to coverage have been harmed, such as medical bills or repair estimates. After you have submitted the statement of dispute, the insurance company will review the claim again and make a new decision. If you still disagree with the decision, you can appeal it by filing a complaint with the Washington Office of the Insurance Commissioner (OIC). The OIC will investigate the matter and help you resolve the dispute. During the complaint process, you can provide additional information, testimony and documents to support your position. The OIC may also arrange for an independent examination or mediation to help reach an agreement. If an agreement cannot be reached, the OIC will issue an enforceable order on the matter. If you are still not satisfied with the OIC’s decision, you can file a lawsuit in a state court. The court would review your case and make a final decision on the matter. No matter what route you take, it is important to keep records of all documents, communications and payments related to your insurance claim dispute. This will help ensure that the process is properly followed and you are not financially disadvantaged in the end.
