What is the statute of limitations for filing a liability claim?
In North Carolina, the statute of limitations for filing a liability claim is three years from the date of the injury or occurrence that caused the injury. This includes claims for medical expenses, lost income, and pain and suffering. If the injured person is a minor, the statute of limitations does not begin until the minor turns 18. However, in some circumstances the statute of limitations may be extended. For example, if the injured party did not realize the injury was caused by the negligence of someone else, or if that person was not aware that the injury was significant or had later effects, the statute of limitations may be extended. In these cases, the statute of limitations begins when the injured person becomes aware of the injury or the occurrence that caused the injury. It is important to note that if the injured person does not adhere to the statute of limitations, they may be unable to bring a claim or may significantly decrease their chances of success. This is why it is important to speak to an attorney as soon as possible after an injury or accident so that the appropriate steps can be taken in a timely manner to preserve the injured party’s rights.
