What is an affirmative defense?

An affirmative defense is a type of legal defense available to those accused of violating an insurance claim law in Arizona. It is a sworn statement made by the defendant which acknowledges that they have broken the law, but that the circumstances surrounding the violation may have excused their behavior. In other words, the defendant is claiming that, even though they did technically violate the insurance claim law, they had mitigating factors that should excuse their behavior. These mitigating factors can include anything from not being aware of the specifics of the law to having some kind of external pressure put on them that caused them to break the law. The court is the only one who can ultimately decide whether an affirmative defense is valid or not. Ultimately, if the judge decides that the affirmative defense presented is valid and that the defendant had no other reasonable option, they may choose to reduce or even drop the charges. In Arizona, as with most other jurisdictions, the burden of proof is on the defendant to show that their affirmative defense is valid and that they should not be held liable. In order to do this, they must present sufficient evidence to the court to prove that they acted reasonably and responsibly. Furthermore, they must present evidence that the alleged violation was in fact excusable in their particular situation.
