What happens if my asylum application is denied?
If your asylum application is denied, it means that the Refugee Asylum Office (RAO) has determined that you do not qualify for asylum under U.S. immigration law. This means you will not be granted protection from removal or deportation from the United States. You may, however, be eligible for other forms of immigration relief, such as Withholding of Removal or relief under the Convention Against Torture. If you receive a negative decision on your asylum application or do not receive a decision within the time frame provided, then you have the right to appeal the decision. In order to file an appeal, you must file a Petition for Review with the federal court of appeals. This must be done within 30 days of the denial. After the petition is filed, the court will review the decision and can either reverse or affirm it. If the court affirms the denial of your asylum application, you may still have an opportunity to challenge the decision in court. You can file a motion to reopen or reconsider your case, as well as a motion to stay any deportation proceedings. Additionally, other forms of relief may still be available to you. It is important to note that if you are denied asylum, then you may be placed in removal proceedings.
