What is “cancellation of removal”?
Cancellation of removal is a form of relief from removal offered by the United States Immigration Court (also known as the Executive Office for Immigration Review) to certain non-citizens facing deportation from the United States. This type of relief can prevent an immigrant from being deported to their native country. Cancellation of removal is available to certain immigrants who meet certain qualifications, such as having been a lawful permanent resident for at least five years, having at least seven years of continuous physical presence in the United States, and establishing that they would suffer extreme hardship if removed from the country. Generally speaking, in California, it is possible for an immigrant facing removal proceedings to apply for cancellation of removal in front of an Immigration Judge. Most applicants must prove that they have been living in the United States for a certain period of time without any major negative incidents (such as criminal history or other violations of immigration laws) and that they would face extreme hardship if their case were not granted. In order to prove extreme hardship, the immigrant must show that their removal would have a significant economic, emotional, or physical impact on an immediate family member or other person who is either a U.S. citizen or a lawful permanent resident. If cancellation of removal is granted, the immigrant is usually allowed to remain in the United States in a lawful permanent resident status. This can be a great relief to individuals facing deportation and a great way to remain in the United States legally.
