Where can I apply for asylum?

In the state of California, asylum seekers may apply for a grant of asylum in one of two ways: through the U.S. Citizenship and Immigration Services (USCIS) or through the Executive Office for Immigration Review (EOIR). To apply for asylum through USCIS, the applicant must submit Form I-589, the Application for Asylum and Withholding of Removal, as well as proof of his or her identity, a list of any dependents, and a statement describing the applicant’s circumstances. Applications may be completed online via the USCIS website, and must be submitted with a filing fee. After completing the form, applicants should bring it to the nearest USCIS office for processing. To apply for asylum through the EOIR, the applicant should present his or her case to an Immigration Judge, who will hear the case and make a decision. This process requires the applicant to attend a hearing before the judge. The applicant should prepare a statement that describes his or her case for asylum, and should also submit any supporting evidence, such as witness statements or documents that prove identity. After the hearing, the judge will make a decision as to whether the applicant will be granted asylum. No matter which way the applicant chooses to apply, the process can be lengthy, and it is important for applicants to ensure that they have all of the necessary information and supporting documents. If granted asylum, then the applicant and any dependents can remain in the United States without fear of deportation.
