What is a “withholding of removal”?
A “withholding of removal” is a type of immigration relief available to immigrants living in California. It prevents them from being removed from the United States to a country where they could be persecuted based on race, religion, nationality, political opinion, or membership in a particular social group. In order to be eligible, a person must first demonstrate that they have a “well-founded fear of persecution” in their home country. This means the person must present evidence that if they were to be sent back to their home country, they would face a real risk of suffering severe harm in the form of physical harm, torture, or death. If the person is eligible, the withholding of removal prevents their removal from the United States, but does not give them a path to citizenship or even lawful permanent residence. It is a temporary form of immigration protection and the immigrant must apply for renewal periodically. In addition, the withholding of removal does not grant the immigrant any additional rights or privileges, such as the right to work or receive public benefits. Although it does provide a measure of safety and security, it is not a permanent immigration solution and the immigrant must always be aware that their status is tenuous.
