What is removal/deportation?

Removal/deportation refers to the official process of forcing someone to leave the country against their will. This can occur when a non-citizen has violated immigration law in some way, such as overstaying their visa or otherwise breaking the law. In New Hampshire, deportation is carried out by the United States Immigration and Customs Enforcement (ICE). ICE agents may serve “notices to appear” which require immigrants to appear in court and answer criminal or civil charges. This often leads to the issuance of a “removal order” by the Immigration Judge. A removal order serves as a notice to leave the U.S. within a certain time period and may also remove any right to return. In some cases, those who have been served with a removal order can be eligible for relief from deportation, such as asylum. This requires filing a petition with the immigration court, and if approved, the individual may be allowed to remain in the country. Regardless of the situation, removal/deportation is a serious consequence for violating immigration law and should always be taken seriously. Depending on the situation, however, there may be possible options for those who are facing removal.
