What is removal/deportation?

Removal/deportation is the process of expelling someone from the United States. In New York specifically, removal/deportation occurs when a person is determined to be present in the country unlawfully or without proper documentation. Immigration judges preside over removal/deportation proceedings and have the power to order a person to be removed from the country, depending on their individual circumstances. Asylum seekers are a particular type of immigrant who flee their country of origin due to fear of persecution based on their religion, political opinion, nationality, or race. To be eligible for asylum one must physically be present in the United States and apply for asylum status. It is important to note that even if someone is granted asylum they are still subject to removal/deportation if they commit certain crimes or other violations of U.S. immigration law. In all cases, removal/deportation is an emotionally complex process for those involved. Deportation can have significant implications for an individual’s chances for future immigration to the United States. To avoid deportation, it is important to speak to an understanding immigration lawyer who can assess a person’s individual case and advise them on the best steps to take in order to remain in the United States.
