What is a “withholding of removal”?

A withholding of removal is a form of protection for individuals who fear persecution if they were to return to their country of origin. It is given under the Immigration and Nationality Act (INA). California is subject to federal law when it comes to asylum, so this form of protection is available to those looking for protection in the state. When an individual applies for a withholding of removal, they must be able to demonstrate that they have a well-founded fear of persecution if they were to go back to their country of origin. This persecution must be based on the individual’s race, religion, nationality, political opinion, or membership in a particular social group. Those granted this form of protection cannot be returned to their country of origin, as they would face persecution there. One benefit of withholding of removal is that it also allows individuals to be eligible for certain benefits, such as the ability to apply for employment authorization, travel authorization, and even eventually for lawful permanent residence in the United States. In California, individuals who feel their life or freedom is in jeopardy or who fear persecution can seek asylum or withholding of removal. It is important to note, however, that not everyone who applies will be granted this form of protection. Each individual’s case will be assessed on its own merits, and a decision will be made accordingly.
