What is an “affirmative asylum application”?

An affirmative asylum application is the process of seeking asylum in the United States that does not begin with the applicant first being placed into removal (deportation) proceedings. Individuals who fear returning to their home countries because of a well-founded fear of persecution due to race, religion, nationality, political opinion, or membership in a particular social group can make an asylum request without first being presented with an order to leave the country. In New York, individuals may go through the affirmative asylum application process through the U.S. Citizenship and Immigration Services (USCIS). The affirmative asylum application starts with the submission of Form I-589, also known as the Application for Asylum and for Withholding of Removal. Often, it may also include supporting documentation, such as evidence in proof of the applicant’s identity, persecution, and other information that corroborates the individual’s claim of asylum. It is important that the applicant answer all questions in the application truthfully and accurately to avoid the application being denied, as any misrepresentation on the asylum application can lead to the applicant being disqualified from seeking asylum. After the application is received and reviewed by the USCIS, the applicant will be scheduled for an asylum interview where an adjudicator will ask questions about the applicant’s case and make a decision on whether to grant or deny the request.
