What is the “reasonable opportunity period”?

The “reasonable opportunity period” is a term used in immigration law, specifically in regards to asylum in Ohio. This phrase refers to the window of time in which an individual can obtain legal assistance for their asylum case. Under the Immigration and Nationality Act, asylees are given a “reasonable opportunity period” within which they are expected to find legal assistance for their case. This “reasonable opportunity period” begins at the time of arrival in the United States and ends 180 days after that. During this time, asylees must use “due diligence” to find legal assistance since immigration proceedings are complicated and can be difficult to handle without it. If, for any reason, an asylee does not secure legal assistance within the “reasonable opportunity period”, their claims can be denied. However, if an asylee can show that they tried to obtain legal assistance but were unable to before the 180-day deadline, they may be granted an extension of the “reasonable opportunity period”. In this case, the asylee must explain the circumstances surrounding their need for an extension and any information that would prove their attempt to obtain legal assistance before the deadline. Ultimately, the “reasonable opportunity period” serves as a window of time for asylees to find legal assistance before their cases can be heard. This period is allotted to give asylees the best chance at success in their cases by providing them a reasonable amount of time to find competent legal counsel.
