What happens if I am found to have a “credible fear”?
If you are found to have a “credible fear” of persecution in your home country, you may qualify for Asylum in Virginia. A credible fear means that if you were to be removed from the United States and returned to your home country, there is a reasonable fear that you would be persecuted or even killed on the basis of race, religion, political opinion, nationality, or membership in a particular social group. If you are found to have a credible fear, you will be allowed to apply for asylum. This application must be made within one year of your arrival to the United States unless you can demonstrate that “extraordinary circumstances” were the reason that you could not apply within that time limit. The asylum application process includes an interview with an immigration officer and a review of your application and supporting documents. If your application is approved, you will be given asylum in Virginia and allowed to remain in the country. You will also be given the opportunity to apply for a work permit, attend school, and adjust your immigration status. In some cases, asylum seekers may be detained if the Department of Homeland Security (DHS) finds that their release into the United States would be a risk to public safety or national security.
