What is a “withholding of removal”?

In South Carolina, a “withholding of removal” is a form of humanitarian relief that is available to those who are not citizens of the United States. It is a more limited form of asylum, which is used to protect individuals from being returned to their countries of origin if they fear persecution there. The withholding of removal is granted to those who cannot prove past persecution, but who can prove a “clear probability” of future persecution if returned to their home countries. This is different from asylum, which requires the individual to prove that they have been persecuted in the past, or have a reasonable fear of future persecution based on their race, religion, nationality, membership in a particular social group, or political opinion. In order to be granted a withholding of removal, the individual must prove that it is more likely than not that they will be persecuted based on one of these factors if removed to their home country. This is a difficult burden of proof that is only granted in certain circumstances. An individual with a withholding of removal must be allowed to stay in the United States, but with limited rights and protections. They are not eligible to receive a green card or U.S. citizenship, and the withholding of removal may be revoked at any time if the situation in their home country improves.
