What is the difference between a “defensive” and an “affirmative” asylum application?
A defensive asylum application is an immigration request filed by someone who is in removal proceedings and is facing deportation. In this case, the applicant will need to present their asylum claim to the immigration judge before they are removed from the country. The individual is asking the court to stop their deportation and grant them asylum. An affirmative asylum application, on the other hand, is a request filed while the individual is currently living in the United States, but not in removal proceedings. The applicant can choose either to file the asylum application with the U.S. Citizenship and Immigration Services (USCIS) or the Executive Office for Immigration Review (EOIR). The individual is not facing deportation when they are filing the application and can choose to receive a decision from the asylum office or a hearing in immigration court. In North Dakota, individuals who are interested in filing for asylum need to meet certain qualifications to be eligible for the process. They must be able to establish that they have suffered from persecution or fear of persecution in their home country due to their race, religion, nationality, political opinion, or particular social group. Furthermore, asylum applicants must also demonstrate that the government of their home country is unwilling or unable to protect them from the persecution they face.
