What is the process for a child to apply for a waiver of the alien relative requirement?
In Washington, a child who wishes to apply for a waiver of the alien relative requirement must follow a specific process set out by the United States Citizenship and Immigration Services (USCIS). The process begins with the completion of Form I-751, Petition to Remove the Conditions on Residence. This form must be filed with accompanying evidence that proves the relationship among the family members. In the case of a child, this evidence can include a copy of the birth certificate, a proof of marriage certificate, and/or evidence of adoption. Once the Form I-751 is completed and accepted by USCIS, the child must submit Form I-601A, Application for Provisional Unlawful Presence Waiver. This form must be filled out and signed by both the child and the parent. The child must also provide the USCIS with evidence that supports their claim of hardship, such as financial hardship, risk of death or serious harm if the child were to return to their home country, and/or the child’s lack of access to basic amenities. The child must then submit the completed Form I-601A, along with proof of the child’s relationship to the parent or relative, to the USCIS. Within 90 days, the USCIS will respond with a decision on the application. If approved, the child will receive a waiver of the alien relative requirement. If the application is denied, the child can appeal the decision to the Administrative Appeals Office of USCIS.
