What is voluntary departure?
Voluntary departure is a form of immigrations relief that allows someone who is facing deportation to leave the country on their own terms, rather than being formally deported by the U.S. government. In Washington, voluntary departure can mean either a deferred voluntary departure or an immediate voluntary departure. A deferred voluntary departure requires the individual facing deportation to depart the country within a specific period of time that is agreed upon by the government and the individual in question. During this period, the individual must obtain a valid passport and make the necessary travel arrangements. Once the individual has left the country, they face a bar from returning to the United States for 3 to 10 years, depending on the circumstances. An immediate voluntary departure requires the individual to leave the country immediately without having any opportunity to obtain a passport or make travel arrangements. They would have to leave the country within 24 hours of the final order of removal. In this case, the individual is also subject to a 3 to 10 year bar from returning to the United States. Voluntary departure is a way for individuals who are facing deportation to have some control over the process and leave the United States on their own terms. However, it is important to understand the potential consequences of voluntary departure, as well as the different types of voluntary departure that are available to individuals in Washington.
