What is a Motion to Reopen?
A Motion to Reopen is a legal document issued by the Department of Homeland Security (DHS) that requests a change in the outcome of a person’s immigration case. This document is used when a person has been ordered to be deported from Washington, and they are hoping to remain in the United States. The Motion to Reopen asks the court to reconsider its decision and potentially change the deportation order. In order to submit a Motion to Reopen, the person has to prove that they have new evidence or circumstances that justify their request for a new decision. The new evidence or circumstances must have been impossible to present at the time of the original hearing. This is because the motion focuses on what has changed since the initial deportation hearing. The person will need to provide evidence that supports their motion. This could include documents such as medical records, letters of support from family, and proof of employment. Once the motion is submitted, the DHS will review it and decide whether or not to grant the motion. If the DHS agrees to reopen the case, the person’s deportation order may be canceled or their deportation may be delayed, usually while their new evidence is evaluated. If the motion is denied, the person will have to leave the country in accordance with their deportation order.
