What is an Expedited Removal Order?

An Expedited Removal Order is a type of deportation order issued by immigration officers in Washington (and nationwide). In an expedited removal, an immigration officer can deport someone from the United States without going through a full court hearing. This order can be used on illegal aliens who are caught at a port of entry, such as an airport or a land border, or who have been in the country less than two years. When an immigration officer issues an Expedited Removal Order, the individual will be immediately removed from the country without any prior warning or legal representation. The individual is usually put on the next available flight out of the United States. In some cases, they may be allowed to stay in the country if they are able to present a valid claim for asylum. In many cases, the individual will not be entitled to certain legal rights or protections, such as an appeal of their removal order. This means that once an Expedited Removal Order has been issued, the affected person will not be able to challenge the deportation in court. In Washington and nationwide, an Expedited Removal Order is a powerful tool for law enforcement to quickly deport those who have entered the country illegally. It is considered to be one of the most efficient ways to process and deport those in violation of U.S. immigration laws.
