What is a Judicial Removal Order?
A Judicial Removal Order is a tool used by the United States government to legally remove non-U.S. citizens from the country. When immigration laws are violated or a person is in the country illegally, the government can initiate deportation procedures leading to a Judicial Removal Order. This order is signed by an immigration judge and is the final decision, meaning the person will be removed from the United States and will not be allowed to return. In Pennsylvania, deportation proceedings must first start by filing an application for a removal order with the U.S. Department of Homeland Security. An immigration judge will then review the case and decide if a removal order should be issued. If the judge decides to issue a removal order, they will set a date for a deportation hearing. The foreign national or their legal representative will be invited to this hearing to present evidence and cross-examine witnesses. After the hearing the judge will make a final decision on whether to issue a judicial removal order. At this point, the person or their legal representative may be able to negotiate with the U.S. government. If the negotiations are successful, the person may be allowed to stay in the U.S. legally. If not, the Judicial Removal Order will be issued and the person will be removed from the country.
