What is a Final Order of Removal?
A Final Order of Removal is an action taken by the U.S. government to officially deport a non-citizen from the United States. These orders are issued by an immigration judge, typically at the conclusion of an immigration hearing. In Texas, the U.S. Department of Homeland Security is responsible for issuing Final Orders of Removal. A Final Order of Removal is issued after a person is found to be in violation of U.S. immigration law. The order is issued by an immigration judge and essentially states that a person must leave the United States and cannot ever return without special permission. Once a Final Order of Removal is issued, the individual must leave the United States within a certain timeframe, typically no more than 90 days. In Texas, individuals with a Final Order of Removal are usually given a one-way ticket to their home country and must report to a federal agency before they can leave the country. If a person is deported from the United States, they will be barred from returning for a period of time, depending on the nature of their removal. In many cases, those who have been issued a Final Order of Removal will not be allowed to enter the United States for at least 10 years, and in some cases, they may never be allowed to return.
