What is a Voluntary Departure Agreement?

A Voluntary Deportation Agreement is an agreement between the immigrant living in Texas and the U.S. government. It is a way for an individual to voluntarily leave the country. This agreement is offered when a person is facing deportation after receiving a Notice to Appear from an Immigration Judge. Under a Voluntary Departure Agreement, the immigrant agrees to depart from the U.S. within a specific amount of time. The immigrant also agrees to leave without the need for an Immigration Judge to make a decision on the case. In exchange for leaving the U.S. voluntarily, the immigrant may be able to avoid certain complications or penalties that could arise from having a deportation order issued against them. Individuals who voluntarily leave the country with a Voluntary Departure Agreement may not be eligible to return for a period of time. Depending on the circumstances, it is possible for the person to petition for a waiver or other type of relief that would allow them to return to the U.S. A Voluntary Departure Agreement is not a good option for everyone. It is important to discuss the situation with an experienced immigration attorney who can help choose the best path for the individual’s situation.
