What is employment-based immigration?
Employment-based immigration is a form of immigration that is based on an individual’s qualifications and skillset that could benefit a company or organization and serve to benefit the economy of the U.S. Generally, employment-based immigration requires that a U.S. employer petition for an individual to receive a work visa. The employer must demonstrate that the individual has a job offer and must also prove that there are no qualified U.S citizens or lawful permanent residents that could fill the role. In the state of Florida, there are a few types of visas available for employment-based immigration. The most common is the H-1B visa, which is for individuals with a specialty occupation that requires theoretical or technical expertise. Other visas include the TN visa, which is specifically for citizens of Mexico and Canada, as well as the E-3 visa, which is for citizens of Australia. Each visa has its own set of criteria that must be met in order to receive the visa. In addition to the visas, certain individuals may be able to enter the U.S. without a visa if they qualify for an immigrant visa. This allows people with extraordinary skills or achievements, such as scientists or researchers, to receive a permanent residence status. This status allows the individual to live and work in the U.S. indefinitely. In summary, employment-based immigration is a form of immigration where a U.S. employer petitions for a foreign individual to receive a work visa with exceptional skills or abilities that can benefit the U.S. economy.
