What is employment-based immigration?

Employment-based immigration is when a foreign national is allowed to work in the United States legally on the basis of a visa granted by the U.S. government. In Virginia, these visas are generally sponsored by an employer and are processed through the U.S. Citizenship and Immigration Services (USCIS). The most common types of employment-based visas are H-1B visas, which allow employers to hire foreign workers in specialty occupations; L-1 visas, which are used to transfer foreign workers between offices of the same organization; and TN visas, which are available to Canadian and Mexican nationals employed in certain professional occupations. The U.S. Department of Labor must certify any employer-sponsored visa petition before a foreign national can be admitted to the United States. The employer must also demonstrate that the foreign national will not displace any U.S. worker, which may include the negotiation of a prevailing wage for the position. The U.S. government places an annual cap on the number of employment-based visas that can be issued each year. There are also specific requirements for individual visa types, such as the length of time a worker may remain in the United States and the number of years such a worker can remain in a certain position. Employment-based immigration is an important source of skilled labor for many organizations in Virginia. It is important to be fully aware of the process, requirements, and qualifications for foreign nationals when sponsoring an employee for a visa.
