What is an O visa?

An O visa is a type of U.S. visa that is available to individuals who possess extraordinary abilities in the sciences, arts, education, business, athletics, or the motion picture or television industry. It falls under the Immigration and Nationality Act and is part of the Employment-Based Immigration system. The O visa is available to individuals who are coming to the United States to work in their field of expertise either temporarily or permanently. To qualify for an O visa an individual must have a job offer or contract from a U.S. employer. Additionally, they must demonstrate extraordinary abilities in their field. For example, they can provide evidence of being acclaimed nationally or internationally for their achievements in the sciences, arts, education, business, athletics, or motion picture or television industries. Additionally, individuals must show sustained national or international acclaim and also that their skills are of significant benefit to the U.S. In Virginia, applicants can fill out the O Visa application (Form I-129) at the nearest United States Citizenship and Immigration Services (USCIS) Location. The application fee is currently $460 and additional fees may be applicable. Applicants must also file an EAD (Employment Authorization Document) application with USCIS. The processing time for an O visa is between 3 and 5 months.
