What is the H-3 trainee visa?

The H-3 trainee visa is a non-immigrant visa for individuals who need to participate in a training program that is not available in their own country. This visa is specifically for those who would like to come to the United States to gain experience in their chosen field and to learn skills and knowledge that they will take back to their homeland. In order to apply for the H-3 visa, the applicant must have an offer of a structured training program from an organization within the United States and must show that they have the qualifications and skills to complete the program. The training can include practical work experience, classroom instruction, or a combination of the two. The H-3 visa allows the visa holder to stay in the United States for up to two years. During this time, the H-3 trainee may not engage in gainful employment. In addition, they must be able to show that the training they are receiving will benefit their home country when they return. In New York, employers may hire foreign nationals on H-3 visas as long as they comply with the Department of Homeland Security’s requirements. The employer is responsible for providing the necessary documentation to prove that the H-3 trainee is qualified and will benefit from the training. Once the foreign national has completed their training, they must return to their home countries and are not eligible for permanent residency in the United States.
