What is the H-3 trainee visa?

The H-3 Trainee visa is a visa available to foreign nationals who wish to enter Virginia for the purpose of receiving training, either in a specialized area of work or in a program resulting in valuable educational experience. This training must not be provided in the individual’s home country. To be eligible, applicants must have an offer of employment from a U.S. employer and must be able to demonstrate that the training they will receive is not available in their home country. The training that is provided to the applicant must be specified in the H-3 trainee application and must correspond with the applicant’s range of skills and goals. The training must benefit the foreign national by developing and increasing their skills, while not taking away an existing job opportunity from a U.S. citizen. In Virginia, the H-3 trainee must also be sponsored by an employer, educational institution, or other organization that must promise to provide the required training and be able to demonstrate how this training will benefit the foreign national. In addition, the foreign national must agree to return to their country of origin once their training is complete. Those who are accepted for the H-3 trainee visa are allowed to stay in the United States for up to two years.
