What is an L-1A visa?

An L-1A visa is an employment-based visa that allows foreign companies to transfer employees from their international offices to their offices in the United States. This type of visa is available to foreign companies that have existing relationships and operations in the United States and have been “doing business” for at least one year. Individuals applying for an L-1A visa must have been employed by the international branch for at least one year in the previous three years in an executive or managerial capacity. Executive capacity is defined as having authority to make decisions and control business operations. Managerial capacity is defined as managing a department or an organization and supervising and controlling the work of other employees. An L-1A visa also allows foreign companies to transfer employees to the United States on a temporary basis. This visa is valid for an initial period of three years and can be extended up to seven years. The main purpose of this visa is to allow employees to temporarily establish or direct an office functioning in the United States. Additionally, an L-1A visa holder’s spouse and unmarried children under the age of 21 may be eligible for an L-2 visa to accompany the visa holder during their stay in the United States. This is beneficial for families that need to relocate for the visa holder’s job. In Washington, potential L-1A visa applicants must meet all eligibility criteria and follow the correct procedure when applying for the visa. Working with an experienced immigration attorney may help ensure that the application and required documents are properly put together and submitted.
